Competition Terms and Conditions


Competition Schedule (‘Schedule of key terms’)



  1. Promoter:alice McCALL Pty Limited ACN 115 260 903 (Promoter).
  2. Entry Requirements: Entrants may be of any of age (if an Entrant is under 13, they must obtain written consent to enter this Competition from their parent or guardian), must reside in Australia and must, within the Promotion Period:

(a)   log in or sign up to Instagram, setting the account to “public”;

(b)   follow the alice McCALL Instagram page: @alicemccallptyltd;

(c)   post a comment, tagging a friend on the ‘Win a Wardrobe’ post on the alice McCALL Instagram page; and

(d)   ‘Like’ the ‘Win a Wardrobe’ post on the alice McCALL Instagram page.

An entry will be deemed to be received if it appears on the alice McCALL Instagram page and the date and time listed by Instagram.

  1. Maximum entries: There is no maximum number of entries per person. An Entrant may enter the Competition as many times as they like by tagging a different friend (in a separate comment) each time.  Each comment containing a different tag will constitute a new entry, subject to these terms.
  2. Number of winners: There will be a maximum number of 4 Winners.
  3. Territory: Australia-wide.
  4. Promotion Period:  The Entry Period commences 9:00am AEST, Tuesday 17 July 2018 and ends at 11:59pm AEST on Monday 13 August 2018.
  5. Prizes: Four (4) Winners will receive an alice McCALL Wardrobe valued at $1,000.00 ($1,000 Prize), as set out in Part B of these terms and conditions.  

For the purposes of this Competition, the total prize pool is estimated to be no more than $4,000.00. 

  1. Prize date and selection of winners:

alice McCALL will collate entries on an excel spreadsheet and print out the spreadsheet at the alice McCALL Head Office at Level 1 / 55 Mentmore Ave, Rosebery NSW 2018 (Head Office).  The Winners will be selected by blindfolded random selection by an alice McCALL employee at the Head Office on the drawing dates set out below.

$1,000 Prizes

There will be one (1) ‘Win a Wardrobe’ post on the alice McCALL Instagram page posted each week and $1,000 Prize Winners will be drawn from the entries on each post at the end of that week.

One (1) Winner will be drawn per week on the following dates, each winning a $1,000 Prize:

(i)       2:00pm AEST, Monday, 23 July 2018,

(ii)      2:00pm AEST, Monday, 30 July 2018,

(iii)     2:00pm AEST, Monday, 6 August 2018, and

(iv)     2:00pm AEST, Monday, 13 August 2018.

  1. Publication of winners: Winners will be personally notified by Instagram direct message within 2 business days of the draw.  Winners will also be announced online on the alice McCALL website at within 5 business days of the drawing dates.  Prizes will be delivered to the Winners by email or post upon confirmation of the Winner’s eligibility.
  2. Winner eligibility: Employees of Promoter and family members of employees of Promoter are not eligible to win.  If an Entrant has won a Prize in this Competition previously, they will not be eligible for another Prize.  To be eligible to win, the Entrant must:

(a)   comply with these Competition terms; and

(b)   provide:

(i)      their full name;

(ii)     their email;

(iii)    their address; and

(iv)    elect whether they would like to receive their prize as an alice McCALL in-store gift voucher or an alice McCALL e-boutique gift voucher to alice McCALL,

within 48 hours of alice McCALL delivering the notification of winning via Instagram direct message.



  1. Information on how to enter and information provided in Part A form part of these terms and conditions and by entering into this Competition, each Entrant is deemed to have accepted and understood these terms and conditions.  The Entrant agrees that these terms and conditions constitute all of the terms and conditions between the Entrant and Promoter governing this Competition.


  1. To enter, Entrants must meet all of the Entry Requirements to enter the Competition.


  1. Entry is open Australia-wide.


  1. The Competition will be open from 9:00am AEST, Tuesday 17 July 2018 and end at 11:59pm AEST on Monday 13 August 2018.  All eligible entries must be received by Promoter during this time. Entries are deemed to be received at the time of receipt by Promoter and not at the time of transmission by the Entrant.



  1. In this Competition, an “alice McCALL Wardrobe” means either an alice McCALL in-store gift voucher or an alice McCALL e-boutique gift voucher, as elected by the Winner to alice McCALL in accordance with these terms and conditions, of the value set out in Part A, paragraph 7.

Selection of Winner

  1. The Winner will be selected by random draw at the Head Office set out in Part A, on the dates outlined in Part A. Entries that are incomplete or incomprehensible will be deemed invalid and will be ineligible to win.


  1. Prizes will only be awarded to the person named by the Winner to alice McCALL, subject to their entry complying with these terms and conditions.


  1. As a condition of entry, each Entrant agrees that Promoter may use their name (either in full or in part), likeness, voice and image (including any photograph) in any marketing and the winner will not be entitled to any fee for such use.


  1. If for any reason, a prize or element of a prize is unclaimed by the Winner within 3 months of the drawing date despite reasonable steps by Promoter to contact the Winner, the prize will be re-drawn at 2:00pm AEST the following Friday, in the same manner and at the same place as Part A, paragraph 5 or in accordance with requirements of the NSW Office of Gaming, Liquor and Racing.

Reservation of rights

  1. Promoter reserves the right to request each Winner to provide proof of identity or proof of residency at the address specified in their submission in order to claim a prize. Proof of identification and residency is at the absolute discretion of Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the prize and no substitute will be offered.


  1. Promoter may, in its absolute discretion, modify or cancel the Competition and may administer this Competition in the manner that it considers appropriate in accordance with Australian law.


  1. Promoter reserves the right in its sole discretion to disqualify any Entrant who Promoter has reason to believe has breached any of the terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition or the reputation of Promoter. Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Instagram terms

  1. The Competition is in no way sponsored, endorsed or administered by, or associated with and its related mobile application, both being owned by Instagram, Inc. (Instagram).


  1. The Entrant agrees that it releases Instagram from any and all liability to the Entrant arising out of or in connection with the Competition.


  1. The Entrant must not:

(a)   harass or bully any other person, use offensive language, use language that defames Promoter, or use language that negatively impacts or intends to negatively impact the reputation of Promoter;

(b)   use electronic programs, bots or similar technology to automatically submit entries;

(c)   use multiple Instagram accounts to enter the Competition; or

(d)   tag other accounts owned or controlled by the Entrant to enter the Competition and agrees that it will only tag genuine friends or family in their entry,

and Promoter reserves the right to disqualify any Entrant or Entry that breaches these terms and remove any such entries from the Competition.

Personal information

  1. As a condition of entering this Competition, Entrants agree to provide personal information to Promoter.  Personal information collected during the course of this Competition will be dealt with in accordance with Promoter’s Privacy Policy, located at  Personal information submitted may be provided to third parties for the purpose of administering this Promotion and distributing the prizes, including to agents, contractors and prize suppliers.  Promoter may also use this personal information to contact you regarding, marketing, offers or Promotions from time to time.

Exclusion of liability

  1. Promoter accepts no liability for any late, lost or misdirected including due to technical disruptions, delayed or misplaced postage, network congestion or for any other reason.  To the maximum extent permitted by law, Promoter will not accept any liability for any error, omission or failure to administer this Competition. 


  1. Except for any liability that cannot be excluded by law all Entrants release from, and indemnify Promoter (including its officers, employees, agents and contractors), against, all liability (including negligence), cost, loss or expense arising out of acceptance of any prize(s) or participation in the Competition including (but not limited to) loss of income, damage to property and personal injury whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.


  1. Except for any liability that cannot be excluded by law, Promoter (including its officers, employees, agents and contractors) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Promoter ’s control); (b) any theft, unauthorised access or third party interference; (c) any error by Promoter staff; (d) any variation in prize value to that stated in the Schedule; (e) any tax liability incurred by a winner or Entrant; or (f) redemption or use of a prize.


  1. These terms and conditions are governed by and will be construed under the laws of New South Wales and the parties agree to submit to the exclusive jurisdiction of the courts of New South Wales and its appellate courts.


  1. Failure by Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


  1. Capitalised terms used throughout these terms and conditions are defined in the Schedule unless specified otherwise.
